Murder suspect taken into custody near Mexico border

Lukeville, Ariz. - Murder suspect Timothy Boham was taken into custody by U.S. Customs and Border Protection officers Thursday morning in Arizona.



Officials say Boham was loitering around the customs inspection facility in Lukeville, Arizona. Officers approached Boham who told them he was being sought on a murder warrant.
Police soon confirmed a first-degree murder warrant had been issued for him and he was taken into custody without incident.
An Immigration and Customs Enforcement official told 9NEWS Boham had recently crossed back over the border from Mexico.
Boham is suspected of killing 43-year-old businessman John Paul Kelso.
Denver Police say Kelso, who went by J.P., was found dead Monday at his home located at 3601 7th Avenue Parkway, near Monroe Street in Congress Park.
Police say Kelso was shot, and through the investigative process, were able to identify Boham as the suspect.
Kelso was the co-owner of a collection agency called Professional Recovery Systems, according to workers.
Co-workers remembered Kelso as a loving and giving person.
Denver Police say they were called around 9 a.m. Monday and when paramedics arrived they first thought the man could have died from natural causes, but later determined it was a homicide.
Officials are currently making arrangements to have Boham returned to Colorado.

(11-14) 15:40 PST SAN FRANCISCO -- The Board of Supervisors voted today to outlaw the use of Styrofoam and other polystyrene products by city restaurants and to effectively decriminalize the use, sale and cultivation of marijuana by adults.

The food container legislation, introduced by Board of Supervisors President Aaron Peskin and approved unanimously on the first of two votes needed for passage, would apply to about 3,400 restaurants in San Francisco as well city facility food service providers and food vendor companies contracting with the city. It is scheduled to be implemented June 1, 2007.

Polystyrene containers are blamed for filling up landfills and breaking down into smaller nonbiodegradable pieces that harm marine and other wildlife when they are ingested.

In passing the ordinance, San Francisco joins number of other cities around the country, including Oakland, Portland, Ore., and Berkeley, which banned Styrofoam and similar products nearly 20 years ago.

The marijuana legislation, which passed on an initial vote 8-3, would set nearly all crimes involving marijuana as the lowest law enforcement priority for city police and urges the district attorney to adopt the same policy when prosecuting criminal defendants.

It passed with the blessing of the police officials, but over the complaints of some residents who say the marijuana trade attracts or occurs along with other criminal activity that undermines the quality of life in their neighborhoods.

Ammiano introduced the legislation in August at the behest of groups pushing for the national decriminalization of marijuana.

(11-13) 15:23 PST SAN FRANCISCO -- San Francisco's Board of Supervisors will vote Tuesday on legislation that would set nearly all crimes involving marijuana as the lowest law enforcement priority for city police.

The legislation, sponsored by Supervisor Tom Ammiano, was approved today by a board committee with the blessing of police officials and over the complaints of some residents.

'This measure, which would legalize the unlimited growth and sales (of marijuana) on private property, will make public spitting and (leaving chewing) gum ... on the sidewalk higher priorities,' said Kim Stryker, voicing opposition before the supervisors' City Operations and Neighborhood Services Committee.

Ammiano introduced the legislation in August at the behest of groups pushing for the national decriminalization of marijuana. He defended the policy move, saying it is consistent with Proposition W, a measure passed in 1976 by city voters calling for an end to marijuana arrests and prosecutions, and state Proposition 215, which provides for medical use of cannabis.

'There are manybetter ways that we can be using our tax dollars and empowering our law enforcement than wasting money and police resources on marijuana offenses," Ammiano said. "This ordinance would allow San Francisco to join other forward-thinking cities. It will not result in San Francisco becoming Amsterdam West."

Under the proposed legislation, city police would be directed to essentially ignore most marijuana crimes unless they involve minors or acts of violence, driving under the influence or the sale or distribution of pot on public property or within view from public property.

San Francisco Police Capt. Tim Hedrick, head of the department's narcotics squad, said Ammiano's legislation is consistent with police policy on marijuana crimes. "It does not tie our hands enforcing the law," he told the committee.

But a number of residents protested the legislation, saying it will encourage crime and the use of harder drugs such as cocaine or heroin.

"It will undermine the efforts of people who live in marginal neighborhoods to make their neighborhoods safe, clean and peaceful," said Arthur Evans, a Haight-Ashbury resident. "This measure is an attack on the well-being of our neighborhoods. You should not throw obstacles in our way. You should help us to make San Francisco more safe and livable."

Supervisor Fiona Ma, a member of the committee hearing Ammiano's legislation, also spoke out against it, saying she believed it "establishes a new policy that has not been presented to the voters." Ma broke with Supervisor Jake McGoldrick, the committee's chairman, and Ammiano in voting against the legislation today.

Although the city doesn't track marijuana arrests and prosecutions, the National Organization for the Reform of Marijuana Laws (NORML) has said more than 1,000 people were arrested in cases involving the drug in 2004.

Dale Gieringer of the California chapter of NORML said cities that have adopted a lax policy toward marijuana have not seen it contribute to crime -- which is an argument activists make for legalization of marijuana under federal law.

"We have to start somewhere and we have to act locally," he added."

This election has made a HUGE shift in the way our country will be led. I am thrilled Pelosi has become the first female speaker of the house. I am elated San Francisco values are on the forefront of American politics again. Today is a good day to be an American, Ii's a great day to be a democrat, its a better day to be a San Franciscan, and an amazing day for woman worldwide.
