(05-30) 13:59 PDT SAN FRANCISCO -- Marijuana advocate Ed Rosenthal was convicted for a second time today of violating federal drug laws by growing pot plants for medical patients, but he faces no punishment for the felony convictions, apart from the one day in jail that he has already served.

Rosenthal, 62, of Oakland, a well-known authority on cannabis cultivation, former columnist for High Times magazine and author of a recent book calling for legalization of marijuana, was convicted by a federal jury in San Francisco of three charges of illegal cultivation and conspiracy after a day of deliberations. He was acquitted of a fourth charge, and the jury deadlocked on a fifth charge.

A separate jury had convicted Rosenthal of similar charges in 2003, but the verdict was overturned by an appeals court because of misconduct by a juror who called a lawyer for advice during deliberations. The charges normally carry a sentence of at least five years in prison, but U.S. District Judge Charles Breyer imposed only a one-day sentence, saying Rosenthal had believed he was acting legally because Oakland had designated him as its agent in the city's medical marijuana program.

Federal prosecutors tried to add charges of money-laundering and tax evasion for the retrial, but Breyer refused, saying the government was retaliating for Rosenthal's criticism of the case and his successful appeal. Prosecutors proceeded with the second trial, rejecting the judge's suggestion that they drop the case, but conceded that they could not seek additional punishment for Rosenthal.

Rosenthal was arrested in February 2002 after federal agents seized more than 3,700 marijuana plants at an Oakland warehouse. He was charged with growing marijuana for distribution by a number of medical marijuana dispensaries in the Bay Area.

In both trials, Breyer barred evidence that the marijuana was intended for medical use under Proposition 215, the 1996 California initiative allowing patients to use the drug with their doctor's approval. He also excluded evidence about Rosenthal's designation as an agent by the city of Oakland.

Left without a defense, Rosenthal's lawyers called no witnesses at the retrial, and instead argued that the prosecution's case was tainted by the testimony of some of Rosenthal's former friends and business partners who had been granted leniency.

Because of the judge's rulings, "The jury was not allowed to hear valuable information it needed to make an unbiased and fair decision," Rosenthal said today after the verdict.

His defense lawyers said they would ask Breyer to throw out the convictions.

AIDS Hot Line Number Rings Up Sex Line

A bookmark distributed by the Missouri Department of Health and Senior Services not only teaches teens and children about HIV and AIDS, it provides a phone number that patches them into a hardcore sex hot line.

St. Joseph resident Lori Felzien said she found out about the hot line when her sixth-grade son dialed the number printed on a bookmark he received during a health lesson at Bessie Ellison Elementary School.

The boy handed her mother the phone and said, "Mom, listen to this."

Felzien's reaction: "We've got to get these cards out of these kids' hands."

The toll-free number once belonged to Teens Teaching AIDS Prevention, part of the Kansas City-based nonprofit Good Samaritan Project. But the AIDS hot line went out of service about a year ago and a sex hot line has since taken over the number.

Felzien said she contacted the school and Mitzi Teliczan of the Buchanan County Health Department, which is also listed on the bookmark.

Teliczan said the department approved a series of bookmarks on different topics several years ago. They were distributed throughout local schools over the past few years.

Nanci Gonder, a spokeswoman for the Missouri health department, said her office is attempting to contact HIV and AIDS prevention groups around the state about the mix up.

She said the health department didn't know the AIDS hot line no longer existed until this week. Gonder added that it will now review all phone numbers it distributes.

A man says he broke into an apartment with a cavalry sword because he thought he heard a woman being raped, but the sound actually was from a pornographic movie his upstairs neighbor was watching.

"Now I feel stupid," said James Van Iveren, who has been charged in the case. "This really is nothing, nothing but a mistake."

According to a criminal complaint, the neighbor told police that Van Iveren pounded on the door and kicked it open without warning Feb. 12, damaging the frame and lock.

"Where is she?" Van Iveren demanded, thrusting the sword at the neighbor, the complaint said. "Where is she?"

The neighbor told police Van Iveren became increasingly aggressive as he repeated the question, insisting that he had heard a woman being raped. The complaint said that, with the sword pointed at him, the neighbor led Van Iveren throughout the apartment, opening closet doors to prove he was alone.

The neighbor later played for police the part of the DVD he believed Van Iveren heard downstairs.

Van Iveren, 39, of Oconomowoc, was charged with criminal trespass, criminal damage and disorderly conduct, all while using a dangerous weapon, and is due in court March 5. Together, the misdemeanor counts carry a maximum sentence of 33 months in jail.

Van Iveren said Tuesday that he heard a woman "screaming for help," grabbed the sword, bounded up the stairs, kicked in the apartment door and confronted the man who lived there.

"I intended to hold it behind my back and knock. But I froze and instead, what happened happened," he told the Milwaukee Journal Sentinel.

Contesting his neighbor's account, Van Iveren said he didn't look anywhere in the apartment except the front room, and that he never threatened the neighbor with the sword.

"I had the sword extended. But that was all," he said.

Van Iveren, who lives with his mother in the downstairs apartment, said he did not call police when he heard the noises because he does not have a telephone. He said he barely knew the upstairs tenant.

Police seized Van Iveren's sword, which he said was a family heirloom.

If red tape were edible, the folks over at the Santa Clara Valley Transportation Authority would be feasting in style.

Awhile back, the authority put out a bid for the estimated $2,000 worth of cakes and pastries it serves up at office parties every year. Not just any bid, but a 33-page-long bid.

Among the specifications:

-- Each cake must be delivered with a basic theme or adornment (flowers, streamers, colorful border, etc.).

-- Cakes must be available in a minimum of 11 flavors (peach, lemon and banana nut among them).

-- They must have a minimum of 21 fillings (including peach, pumpkin and chocolate cream), with a minimum of six toppings (peanuts, jimmies and coconut, etc.).

-- They must come in a minimum of seven shapes and sizes.

What's more, the agency has the right to refuse any cake that is the "incorrect size, shape (or) design" or has a "foul odor."

As you might imagine, no bidders responded.

VTA spokeswoman Jayme Kunz called the specificatKunzchecklist a case of somebody having "taken a need to follow process to an extreme level."

Agency General Manager Michael Burns, who used to run San Francisco's Municipal Railway, apparently agreed. Burns hadn't known about the guidelines ahead of time, officials said, and pulled the bid before it could go out again.

By the way, Kunz said she had hoped weKunze calling about better news for VTA -- the state just awarded the transit agency $364 million to get the engineering going on a BART link to Silicon Valley.

"We were going to have a cake to celebrate," she said.

The lighting operator at Slim's really liked Daughtry, the hot new rock band fronted by "American Idol" also-ran Chris Daughtry.

"They've got that totally predictable thing down pat," the stage tech said.

With his first album already past the million sales mark after only 3 months, and a potential hit single lurking in the wings, Daughtry looks to be on the verge of exploding. Fans camped out in front of the club all day Sunday, Super Bowl or no Super Bowl. Actress Michelle Pfeiffer called to request tickets.

Full cell phone camera mania greeted the 28-year-old rock singer with the shaved head and pencil-line beard. The audience looked a little old to be shrieking like teenyboppers, but did anyway.

He may have finished only fourth on last season's "Idol" finals, but he has rapidly passed winner Taylor Hicks and his "Soul Patrol" following in the real world. Daughtry clearly connects with an audience and it would seem to be only the beginning for him.

Wearing a black muscle T-shirt and switching off between electric and acoustic guitars, Daughtry led his quartet through a brisk 50-minute performance. He was properly earnest and deferential. ("If it wasn't for each and every one of you, I wouldn't be standing here.")

Fortunately, he sings with more charisma. He has a tortured bel canto style ideally suited to the agonized songs like "What I Want." His fans -- "Can I call you friends?" he asked -- sang along with every word of "Over You" off the album. He tossed guitar picks into the sea of waving arms after every song.

The North Carolinian is a clean-cut, married man, father of two, who told the radio interviewer during the sound check performance that he left his young children at home on this tour because he didn't want them hanging out at the bars he was playing. Undoubtedly he will return this summer, packaged for the amphitheaters, where they can play backstage and not miss school.

The band came well armed; a bank of Marshall amplifiers, their own mixing board and sound engineer. Daughtry is handled by the management arm of the "American Idol" producers, who brought on as a specialist the man who discovered Hanson. The album was made by the producer of recent hits by Hoobastank, the All-American Rejects and other pop-punk cannon fodder.

One of the songs on the album he wrote without co-writers is "Home," a surefire tearjerker that sounds custom-made to raise goose bumps at the end of some sappy movie. The aptly titled "It's Not Over" is the album's first track currently at radio and it would appear to have an active half-life still remaining before the label pulls the pin on "Home."

The Slim's management estimated they could have sold four or five more shows, ticket demand was so great. But Daughtry chose to stir excitement in the fan base with a loss-leader club tour.

It was a great idea, a real soft landing of a first pass through town. But he probably should avoid the "Sunday Bloody Sunday" cover unless he likes sounding like a half-baked U2 tribute band.

Ugh! there is no reason to ever be in Las Vegas more than 3 days, well accept for the Adult Entertainment Expo and teh Internext Expo, OK fine and throw in Husterball too. The Top it off by the fact that we drove there in a RV. We brought our mobile studio with us. SAN FRANCISCO - Popular gay porn star Andy Dill died Wednesday afternoon in a San Francisco hospital. The cause was meningitis.

The suddenness of the illness' onslaught took everyone aback. "But I just spoke to him the other day," was a phrase that echoed through emails and phone calls as the unhappy news spread yesterday evening.

Murder suspect taken into custody near Mexico border

Lukeville, Ariz. - Murder suspect Timothy Boham was taken into custody by U.S. Customs and Border Protection officers Thursday morning in Arizona.

Officials say Boham was loitering around the customs inspection facility in Lukeville, Arizona. Officers approached Boham who told them he was being sought on a murder warrant.
Police soon confirmed a first-degree murder warrant had been issued for him and he was taken into custody without incident.
An Immigration and Customs Enforcement official told 9NEWS Boham had recently crossed back over the border from Mexico.
Boham is suspected of killing 43-year-old businessman John Paul Kelso.
Denver Police say Kelso, who went by J.P., was found dead Monday at his home located at 3601 7th Avenue Parkway, near Monroe Street in Congress Park.
Police say Kelso was shot, and through the investigative process, were able to identify Boham as the suspect.
Kelso was the co-owner of a collection agency called Professional Recovery Systems, according to workers.
Co-workers remembered Kelso as a loving and giving person.
Denver Police say they were called around 9 a.m. Monday and when paramedics arrived they first thought the man could have died from natural causes, but later determined it was a homicide.
Officials are currently making arrangements to have Boham returned to Colorado.

(11-14) 15:40 PST SAN FRANCISCO -- The Board of Supervisors voted today to outlaw the use of Styrofoam and other polystyrene products by city restaurants and to effectively decriminalize the use, sale and cultivation of marijuana by adults.

The food container legislation, introduced by Board of Supervisors President Aaron Peskin and approved unanimously on the first of two votes needed for passage, would apply to about 3,400 restaurants in San Francisco as well city facility food service providers and food vendor companies contracting with the city. It is scheduled to be implemented June 1, 2007.

Polystyrene containers are blamed for filling up landfills and breaking down into smaller nonbiodegradable pieces that harm marine and other wildlife when they are ingested.

In passing the ordinance, San Francisco joins number of other cities around the country, including Oakland, Portland, Ore., and Berkeley, which banned Styrofoam and similar products nearly 20 years ago.

The marijuana legislation, which passed on an initial vote 8-3, would set nearly all crimes involving marijuana as the lowest law enforcement priority for city police and urges the district attorney to adopt the same policy when prosecuting criminal defendants.

It passed with the blessing of the police officials, but over the complaints of some residents who say the marijuana trade attracts or occurs along with other criminal activity that undermines the quality of life in their neighborhoods.

Ammiano introduced the legislation in August at the behest of groups pushing for the national decriminalization of marijuana.

(11-13) 15:23 PST SAN FRANCISCO -- San Francisco's Board of Supervisors will vote Tuesday on legislation that would set nearly all crimes involving marijuana as the lowest law enforcement priority for city police.

The legislation, sponsored by Supervisor Tom Ammiano, was approved today by a board committee with the blessing of police officials and over the complaints of some residents.

'This measure, which would legalize the unlimited growth and sales (of marijuana) on private property, will make public spitting and (leaving chewing) gum ... on the sidewalk higher priorities,' said Kim Stryker, voicing opposition before the supervisors' City Operations and Neighborhood Services Committee.

Ammiano introduced the legislation in August at the behest of groups pushing for the national decriminalization of marijuana. He defended the policy move, saying it is consistent with Proposition W, a measure passed in 1976 by city voters calling for an end to marijuana arrests and prosecutions, and state Proposition 215, which provides for medical use of cannabis.

'There are manybetter ways that we can be using our tax dollars and empowering our law enforcement than wasting money and police resources on marijuana offenses," Ammiano said. "This ordinance would allow San Francisco to join other forward-thinking cities. It will not result in San Francisco becoming Amsterdam West."

Under the proposed legislation, city police would be directed to essentially ignore most marijuana crimes unless they involve minors or acts of violence, driving under the influence or the sale or distribution of pot on public property or within view from public property.

San Francisco Police Capt. Tim Hedrick, head of the department's narcotics squad, said Ammiano's legislation is consistent with police policy on marijuana crimes. "It does not tie our hands enforcing the law," he told the committee.

But a number of residents protested the legislation, saying it will encourage crime and the use of harder drugs such as cocaine or heroin.

"It will undermine the efforts of people who live in marginal neighborhoods to make their neighborhoods safe, clean and peaceful," said Arthur Evans, a Haight-Ashbury resident. "This measure is an attack on the well-being of our neighborhoods. You should not throw obstacles in our way. You should help us to make San Francisco more safe and livable."

Supervisor Fiona Ma, a member of the committee hearing Ammiano's legislation, also spoke out against it, saying she believed it "establishes a new policy that has not been presented to the voters." Ma broke with Supervisor Jake McGoldrick, the committee's chairman, and Ammiano in voting against the legislation today.

Although the city doesn't track marijuana arrests and prosecutions, the National Organization for the Reform of Marijuana Laws (NORML) has said more than 1,000 people were arrested in cases involving the drug in 2004.

Dale Gieringer of the California chapter of NORML said cities that have adopted a lax policy toward marijuana have not seen it contribute to crime -- which is an argument activists make for legalization of marijuana under federal law.

"We have to start somewhere and we have to act locally," he added."

And no i'm not just babbling, Ive volunteered for The Stop AIDS Project, and others for many years. in-fact i volunteered for SAP way back when i first starting having sex. before drugs, before porn, before it all. if they could not impact there weekly volunteers enough to not engage in risky behavior, then how can the impact a person they harass on the street to take a survey. FYI those surveys they ask you to take about your sex life are just to get them money. each one that is filled out they receive money for from the CDC and other agencies. In fact when i was on the other side of the clipboard, i spent a fair amount of time filing out bogus forms just to help meet their quotas. I'm sure they have saved many lives, but they haven't saved mine. I still support SAP and various other org today and will continue to, because i do believe they make an impact of the naive.
I believe they should focus more on the positive community rather than the negative. They do a much better job educating positive people, then they do negative people.

Folsom Street Fair 2006

While most people will read this and think "My god that was a crazy week" well, for me, egh. it was good, but certainly not a "crazy" week. actually very mild for me. so here we go. Leather Week in San Francisco. Certainly no record breaker. last year i had "sexual experiences" with 47 people. this year, maybe 20, wasn't really keeping track this year. The best part of the whole week was that it went by without a single cigarette. WHEW!

that is if i had to fit my experience into five words. but i don't, hold on its a helluva story.

So every year my best friend and i go camping at an event called Burning Man. we have been going there for over four years now. Burning Man takes place on the Black Rock Desert in northern Nevada. a incredible desolate and remote canvas is the stage to an amazing experience year after year. This year however was much much less peaceful and more dramatic.

This year we decided it would be fun to pull our burner friends together. some of which include a porn star (me), a law student, a crystal addicted former lawyer, and his trick, my roommate's ex-boyfriend, and his crack addicted friend, a DJ, a boring wanna be model, and a few others in between. as well as a group of 30 or so from new zealand who where just using our extra reserved space. So yeah, a big fucking mess. Why on earth did i ever think that a group like that could ever be respectful of one another enough to get through 9 days in one of the most harsh environments in north America. Well we went anyways.

Lets start with the GOOD:
ME: so i decided that i would design and build a shade structure or our group. Brilliant! yes indeed. the structure worked perfectly and even had a few unexpected benefits. See below of my design drawings. I also was supper excited to get a Mohawk. i have wanted to get one for years, and I've always worked into too conservative environment to do it. But this year FUCK-EM. i can get a new damn job with my new fantastic hair.

SEX: ahh god i love sex. i wish it was the only thing i knew how to do. I hooked up with about 5 guys throughout the week. Compared to 9 days in the default world that would be a slow week. But it was great. Sex is so much more amazing out there. One guy in particular was a lot of fun to be with. Michael came with his friend steve from Portland. INJURIES: Well with 5 of our camp-mates getting injured, it sure was a lot of fun. Wow from a girl falling off our bike ramp and scaring her face and breast, to severe arm injuries, to a tweak-er running into a coat rack and nearly taking out his eye. Our camp was full of injuries. we even had a white board up listing all of our camp injuries and at the bottom: "5 hours since last injury". i even had a bit of a scare when i ate some pancakes tainted with oranges, as i am hyper allergic to oranges. As well as a severe tooth ace. So yes we had a lot of trips to the medical tent.

DRAMA: I am an idiot. yes i am. i knew when i was leaving for our trip that it was going to be a big mess, and I still went. Prior to the trip our group basically took sides in a huge battle over respect for our camp mates. and it just escalated on the playa. although most everyone else's drama quited down significantly, mine went through the roof. As previously mentioned i apparently stole this guys trick. I also had an awe full run-in at the sex club Jiffy Lube. this guy started calling me a racist and asshole because i would not let him suck my dick. He was annoying, why on earth would i encourage him to be around me. so i was a dick when he kept trying to talk to me while we where in the sex club. which if you have never been, is very bad sex club edicate. So he starts a yellin. ugh. in the end i told him to fuck off that i have probably had sex with more black guys than the number of times he has touched his own dick. None the less he still with all his ranting and yelling was unable to keep me from hooking up with someone. FUCK OFF DUMBASS! Yet there is more. Jason the ex-boyfriend of my roommate (female). What a fucking selfish son of a bitch. I know i am very narcissistic and self centered but this guy blew me out of the fucking water. wow! i have never experienced someone so selfish. So of course we went to blows, and one time almost physically. I'm not one to physically fight someone, but he sure did get me stirring.

I'm sure that after i decompress the negative memories will fade faster than the good ones.

Overall it was certainly another life changing experience. although isn't everything life changing.

Residents of four San Francisco apartment buildings damaged by a five-alarm fire across from Mission Dolores hunkered down in temporary shelters Friday as firefighters mopped up what authorities called the worst blaze the city has seen since 2002.
Six residents were treated for minor smoke inhalation from the blaze, which erupted about 2:35 a.m. and left 66 people homeless. The wind-whipped fire started on the second floor of 3330 16th St., then it spread to other floors and adjacent buildings, fire Capt. Pete Howes said.
The fire caused about $8.6 million in damage to property and possessions, Howes said, adding that the roof of a fifth building was also damaged.
Some 120 firefighters responded from as far away as the Sunset District. The first firefighters to arrive quickly summoned additional help, and the fifth alarm was sounded about 3:10 a.m.
Residents of the buildings awoke to the sound of smoke alarms and a raging fire.
"It was a wall of black smoke," said Chris Beahn, 34, who lives on the top floor of 3334 16th St., one of the damaged buildings. "After I opened the front door, I couldn't see a foot in front of me, so I closed the door."
Beahn put on his shoes and jacket before grabbing his bag, rushing to the back door and scrambling to the roof. From there, he dashed to the rooftop of an adjacent building, where a firefighter led him down a ladder.
Paul Camarillo and his partner, Vincent Escareno, both 40, were asleep in their ground-floor apartment at 3320 16th St. when Camarillo awoke to a thundering sound.
"I knew there was a fire," he said. "I heard screaming. I looked out the back window and saw embers raining down from the sky."
They grabbed their year-old Maltese dogs, Tictac and Chicklet, and a couple of Escareno's paintings before running for the door.
"I saw a ball of flame out the back window," Escareno said.
As they rushed out, firefighters rushed in, ordering residents to evacuate. Firefighters rescued two women and two children from the third floor of 3320 16th St. as the wind pushed the flames across the building's flat tar roof.
"It went very quickly," Howes said. "The wind conditions there are really crazy."
Mission Dolores and its basilica, and neighboring Congregation Sha'ar Zahav synagogue, were not damaged because the wind blew the flames away from the buildings.
The Red Cross is housing 17 people chased from the buildings.
In addition to people, firefighters rescued a number of pets from the fire.
"I can't even count them," Howes said. "There were firefighters walking out with cats, rabbits, dogs."
One of the rabbits, a brown-and-white bunny named Conor, belongs to resident Ashley Lincoln, who had been forced to flee the blaze without him. She pleaded for firefighters to go back inside and rescue the rabbit.
A firefighter went inside the smoky apartment, found Conor munching rabbit food from his bowl and carried him to safety.
Some of the rescued animals were being housed at the city's Animal Care and Control shelter.
Investigators will spend days sifting through debris to determine where and how the fire started, Howes said.
Authorities said the fire was the largest in San Francisco since the 2002 Cannery fire near Fisherman's Wharf. That five-alarm fire started in the historic Haslett Warehouse and caused millions of dollars in damage.

After my crazy 3 week run, i wasn't really in the mood. so at about 9pm i went walking through my neighborhood. tons of people were lighting fireworks in the street. the air reeked of gun powder. I LOVE THAT. I made it to the top of Dolores Park just in time for the start of the SF City fireworks in the skyline.
